Dash info says my tailgate is open.. it’s not what’s happening here?

Off the top of my head, one or both microswitches at the side of the bottom tailgate, or the central motor that latches the top one, are sending off a wrong signal.
You make sure they are properly latched - spray with oil and don't need to slam brutally, just make sure they click close
You can also click them all closed manually with a screwdriver, drive off (with the tailgates open but "locked") and see if after you start to move get the dreadful beep.
If does not work, time to get to check electrical connections ...

If you operate the latch with a screwdriver it has a partially latched and a fully latched position. If the latch needs adjusting and it is only latching on the first one, it will be closed but will still show as open. It needs to be latched fully to operate the switch.

Can the latch be adjusted? It looks to me that the driver side latch is not engaging

The switch is in the centre latch where the upper tailgate latches into the lower one. The side latches for the lower tailgate can be checked the same way with a screwdriver and the strikers on the body can be adjusted to get them to latch evenly.

Yes, you do not have adjustment for the latch on the tailgate itself if I remember tight, they only screw to the tailgate.
As Richard says, if you adjust the striker you can get it to latch better. Remember this also "moves" where the tailgate will sit once latched, this means more "in" or "out" of the car.
It can be difficult to get it right (I still have not done properly mine), I am using the tail lights as reference, but I still can't get it right ...

I replaced a faulty catch driver side and now it works at least it locks and is not loose however the Tailgate open is still on dash is there a reset or a bypass I could do?

There is a microswitch on the back of the latch which is closed circuit when the tailgate is open and open circuit when it is closed. It could be that it is worn and not operating or it has fallen off the latch. Take the carpet panel off the lower tailgate and you can get to the latch to check it.

The main lock in the centre, the one that latches the upper tailgate to the lower.

I disconnected a little terminal block and the tailgate open on dash has gone.. so that will be ok for me thanks again for your help

As long as you left the latch connected so you can still open it......
